The following explains our Terms of Use and Privacy Policy. You must click “I agree” to view and/or purchase content appearing on this site, including but not limited to Livestream Training Sessions, video clips, and digital copies of articles (hereinafter “Content”) appearing or available through the Intelligent Existence® website (hereinafter the “Website”). You must be at least 18 years old to register.

Purchases, Credits and Cancellations:

Purchases: The payment method used to purchase content determines the Terms and Conditions that apply when upgrading, downgrading, cross-grading or cancelling a purchase. 1. Purchases in India: Intelligent Existence processes website payment transactions for our customers in India using Razorpay. These payments are processed by our agent in India, AAP Media Private Limited, located at A-10, Pocket A, Okhla I, Okhla Industrial Area, New Delhi, Delhi 110020. 2. Purchases in Nepal: Intelligent processes website payment transactions for our customers in Nepal using eSewa and Khalti. These payments are processed by our agent in Nepal, Intelligent Existence Nepal, located at Ward 5, Pokhara, Gandaki, Nepal . All transactions are governed by the laws of Nepal. Refunds and Credits and Cancellations: Due to the inherent nature of its content, Intelligent Existence does not provide refunds or cancellations. At the sole discretion of Intelligent Existence, a partial credit may be issued, for a purchase deemed to be made in error on the website.

No Warranty: INTELLIGENT EXISTENCE® DISCLAIMS ALL WARRANTIES WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Intelligent Existence® may not be held liable for any losses, inconvenience or expectation damages arising from any claim of failure to deliver items either as to condition of the goods or timeliness of delivery through the Website. Digital Content is sold or distributed without any warranty and Intelligent Existence disclaims all responsibility and liability for any harm to any computer system or software, loss of data, or other harm that results from access (authorized or otherwise) to the Website or use of Content originating from Intelligent Existence.
Copyrights, Usage, Transferability and Trademarks: Violations of the restrictions below may result in the suspension or termination of a User’s account or, at the sole discretion of Intelligent Existence®, criminal or civil prosecution as it deems appropriate:

You may not copy, duplicate, redistribute, display, modify or create any derivative works based upon items downloaded, whether distributed free of charge or not, from the Intelligent Existence® Website. If you wish to do so, you may email: [email protected] stating your intended purpose. Permission to use, modify or distribute Content is solely at the discretion of Intelligent Existence®.
You may not upload any Content found on Intelligent Existence directly to any social media or file-sharing site.
You may not reverse engineer, decompile, copy or otherwise use the design of the Website in any way, and acknowledge that the design of the Website, including its underlying computer code, graphic interface and incorporated design elements are proprietary to Intelligent Existence.
The copyrightable material available on Intelligent Existence® is protected by internationally enforceable copyright law, the infringement of which may subject you to civil or criminal prosecution.
Intelligent Existence® Content is provided for personal downloading and viewing only and may not be publicly displayed (such as in groups). For unusual circumstances, email [email protected].
You may not share your password or login details with other persons, and accounts are not transferable to other individuals or entities.

Digital Millennium Copyright Act: If you believe that any material appearing on Intelligent Existence® violates your copyrights, you may follow the procedures described under § 512(c) of the U.S. Copyright Law under the Digital Millennium Copyright Act (DMCA). You must provide the following information: (i) the URL of the allegedly infringing work; (ii) a Registration number or other factual basis for asserting that you are the rightful copyright owner; (iii) your complete contact information including a physical mailing address; and (iv) a statement avowing that you have a good faith belief that use of the copyrighted materials as described above is not authorized by the copyright owner, its agent, or the law, and that under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Shipping and Handling / Delivery: Intelligent Existence® provides product content in the form of streaming media and/or downloadable files only. Downloadable versions are provided at the discretion of the publisher.

Privacy and Personal Identifying Information:

Using the Intelligent Existence® Website requires that you provide certain Personal Identifying Information. Such information may include the following: social media data, name, address, email address, home telephone number, mobile phone number, residential address and credit card information held either directly by Intelligent Existence or provided to a third-party vendor employed to facilitate purchases of Content.
This information may be shared with third-parties for marketing purposes and you may receive updates, special offers and announcements of new products unless you follow the “Opt-Out” procedure below. Our Privacy Policy may change from time to time to ensure conformity with best practice.

Children 13 and Under: Intelligent Existence® does not solicit to and will not knowingly accept registration from children 13 years of age or younger. If you are a parent or legal guardian who wishes to provide access to the Intelligent Existence® Website or content for your child, contact [email protected]. Such access may or may not be granted on a case-by-case basis.

Computer Information and Metadata: Some information is automatically collected when you access the Intelligent Existence® Website from a computer or mobile device. This information may include the type of operating system used, the User’s IP address, the web browser or mobile device used, and information about websites visited before and after accessing the Website. Intelligent Existence® retains the right to use this data for its own purposes such as internal system maintenance, security or quality assurance, policy review or product development, online advertising, as well as using this data to fulfil orders purchased through the Website.

The Website may use session “cookies” (text files such as html files, Flash files or other technology) to enhance the security and functionality of the Website. Commenting Policy: The Intelligent Existence® Website allows registered Users to add comment to certain sections accessible through the Website.

The use of this feature is subject to the following restrictions:

Intelligent Existence® is not the author of any such comments, and is shielded from liability under Section 230 of the Communications Decency Act (47 U.S.C. § 230);
Notwithstanding the above, Intelligent Existence has the unilateral right to remove any comments it deems in its sole discretion to be abusive, defamatory, obscene or otherwise inappropriate, including commercial solicitations or advertisements;
Users who post comments subject to subparagraph (b) above may have their access or account suspended or revoked.
Intelligent Existence® does not review or approve any comments prior to posting to the Website and assumes no burden to do so. If you believe that a Comment violates your personal rights such as privacy or defamation, you may email [email protected] with a copy of the allegedly infringing material and an explanation of why you believe your rights are being violated;
In the event that a User posts a comment in violation of subsection (b) above, Intelligent Existence may use the Personal Identifying Information described in Section 5 above in order to maintain the security and integrity of the Website and its contents, including but not limited to legal or regulatory actions;
Intelligent Existence® does not warrant, promise or otherwise guarantee the anonymity of any User who posts a comment; and Intelligent Existence® will cooperate and disclose any Personal Identifying Information as described in Section 5 above in response to any law enforcement request or any facially valid subpoena without notice to the User.

Policy and Contractual Enforcement: Intelligent Existence® may also use or disclose any of the above-described information when it is necessary to investigate violations of our Terms of Use; to enforce compliance with applicable law; or when necessary to limit Intelligent Existence’s legal liability or protect its rights or property.

Legal Remedies: User understands and agrees that:

Any legal dispute arising from the Terms and Conditions described herein shall be adjudicated under California law;
Users agree to submit to the jurisdiction of the Federal District Court of the Central District of California or, at Intelligent Existence’s sole discretion, the home jurisdiction of the User, and that venue for any action shall be so similarly determined at Intelligent Existence’s sole discretion;
In the event of a default judgement against a User, without regard to laws of the jurisdiction in which User resides, any default judgment (including equitable relief) shall be enforceable in the User’s residential jurisdiction, and User waives any challenge to such entry and execution of judgment in that jurisdiction.
